kumark08 Posted December 28, 2011 Report Share Posted December 28, 2011 Hi, i got H1B first time in oct 2009, and was on bench for couple months( oct-nov), so i didn't have W2 for that year. I do have W2 for 2010( 2009 DEC -2010 DEC) and current pay stubs. Now i've transferred to another company. Will 2009 W2 effect my visa stamping? i'm going for first time H1B stamping. JoeF Posted December 28, 2011 Report Share Posted December 28, 2011 On H1, you need to get paid ALL THE TIME, even on bench. That's the law. Why did you wait for 2 years before checking on this? You could have gotten the money you are owed if you had filed a complaint with DOL on time. Link to comment

There have been instances where people got into problems with this even when they applied for naturalization. Now, in most cases they don't check for more than a few years back, but if there is anything else suspicious or shady, they very well may. Link to comment
