Attorney_24 Posted December 23, 2011 Report Share Posted December 23, 2011 Generally, an individual is eligible for a three year extension of H-1B status when he has an I-140 approved and when an immigrant visa number is not available. Generally the three year extension is possible with an employer other than the GC sponsoring employer. pontevecchio Posted December 24, 2011 Report Share Posted December 24, 2011 The 3 year extension is only possible if the I140 is revoked after the 3 year extension and not before. In this case the 3 year extension will stand even were the I-140 to be subsequently revoked. Link to comment
