DamienMartin
I got my H1 Visa approved through change of status (COS) from L1. Thus, I did not go for a stamping and got a new I94. My question is, if I leave US and go to my home country for vacation, do I have to get my visa stamped while returning back to US? If yes, are there any rejections during the same (especially If I work for contractor) Link to comment
prajal.sutaria
Yes, You will need to get Visa stamping at embassy. Till you have your supporting documents with you there should not be any issues with stamping. Link to comment
pontevecchio
You need a H1 Visa to return. You can minimise the chances of rejection by discussing with a Lawyer appropriate documentation to carry. Link to comment
Attorney_23
Ordinarily, a foreign national who files to change to L-1 status would need to obtain an L-1 visa to reenter the U.S. You may wish to consulate with an experienced attorney who can review your situation and determine the liklihood of success in obtaining such a visa. DamienMartin
Are there any other options to get the visa stamped, say by visiting some other country for a day or so (Canada,Mexico,Bahamas)? Also, if my kid was born in US, will it have any effect on my Visa interview? Thanks Link to comment
pontevecchio
"You may wish to consulate with an experienced attorney who can review your situation and determine the liklihood of success in obtaining such a visa." Thefact that your child was born here is immaterial. Link to comment
