Scorpio811
I am a Physicaltherapist. I am planning to transition to a job in which I get paid only for the number of hours worked. (in contrast to an assured fixed salary). I was just wondering if it is in compliance of the H1B laws Can anybody advice about the legality of this? Thanks in advance Link to comment
livliv
Petition can be filed as part-time. Consult an attorney. Link to comment
JoeF
The LCA specifies a number of hours/week. You need to get paid for that, no matter what. Link to comment
Scorpio811
@livliv. This situation is not similar to part time. The employer says the number of hours of work could vary depending upon the availability of work. I will take your advice & will certainly consult their attorney with this question @Joef. Thanks JoeF I will use this answer when I speak to their attorney Thanks people. This forum is very informative & helps us take informed decisions. Sometimes, even the company attorneys do not advice the right things but once they are given some info, they respond better Link to comment
