First H-1B started in Oct 2007 with Company A

1st contract with the client started in Mar 2008

Changed from Company A to Company B in Sep 2011

Planning to start GC process.

My ex-Employer (Company A) is not willing to provide an experience letter with the START DATE of OCT 2007. Instead he is insisting on giving from MAR 2008; since he started paying me from that month.

Will this be an issue during my GC process.

What is the correct procedure to follow in these circumstances.

Please advice, it is urgent. Thank you for your time and consideration...

please consult a lawyer.

were you employed and getting paid during 10/2007 to 3/2008? you were in violation of H1 during that period if you were not getting paid.

you have started working on 3/2008 so your employer is only willing to give you an exp letter with that start date. your issue is not the exp letter but being potentially out of status if you were not getting paid during 10/2007 to 3/2008.

I had/have only one H-1B at any given time (i.e. no multiple H-1B's).

I didn't get paid for the period for the months from Oct '07 till Feb '08.

Also, I didn't leave the country and re-enter after I got my H-1B approved.

Can I file for back wages after so many years and use the experience letter with Mar '08 as started. Will this help?

Thank you for the replies!
