The company has to pay for your flight back to your country if you wish to go back. How long asylum period will I have to stay in San Diego? Huh? An H1 has nothing to do with asylum. Link to comment
livliv Posted December 15, 2011 Report Share Posted December 15, 2011 Asylum? Are you going to apply for asylum? It is meant for victims for wars, political crimes and such I guess. Do you have any reason for claiming that? Normally you have zero days to stay in the US, if a change of status or transfer is filed within a short time USCIS at its discretion can ignore the out of status period. The employer is required by law to pay for your airfare to home country if they terminate you earlier than H1 petition end date. Link to comment

wiweq Posted December 16, 2011 Report Share Posted December 16, 2011 No grace period. From the very next day of lay off, you are out of status. As per my experience, cancelling/ revoking of H1b is online now, and USCIS is denying Change of Status, if you are even 2 days late. Link to comment
