h42h1visa Posted December 14, 2011 Report Share Posted December 14, 2011 Hi All, As my h1 extension got denied, i left the country in June 2010 to India and then re enter US in Nov 2011 on H4 visa. I was out of the country for more than 1year, Now if i want to change my status back to H1B do i fall in to quota or not ? Any suggestions would be greatly appreciated!!! pontevecchio Posted December 15, 2011 Report Share Posted December 15, 2011 You are not subject to cap if you wish to utilise the remainder of your total of 6 years....6 years minus time you have spent in H1 status. You are subject to cap if you wish to get a new 6 year term in total in H1 status. Link to comment
