Iam_crazy Posted December 14, 2011 Report Share Posted December 14, 2011 My wife was on H4 . She applied H1 through company A in July 2011 and we got a different offer through company B in Oct 2011. Company B applied in premium and it was approved and we started working for company B. Now Company A got an RFE and we told them that we got a different opportunity and we want to join B. But they are saying that you cannot apply multiple h1b visa from h4 through different companies in same year, else both will be cancelled. Also, speaking to one of my friend he says there is a way in which company A can sue us. Also Company A is saying that they want to see Company B's I-797 before cancelling the H1, but I really don't want to send them. Please suggest what we need to do.. PS: we already paid company A $4k for applying H1. Thanks in Advance Link to comment

Stop talking to A and proactively keep a Labor Lawyer in the loop in your state in case A starts some nonsense. One can have a hundred employers file a H1 petition for one..in theory..
