hpjack433 Posted December 13, 2011 Report Share Posted December 13, 2011 My Wife who was on H4, got a job in a different state (Texas) and now my question is, do you think she has to be physically present in Florida to apply for SSN or do you think she can apply for SSN while staying in Texas? She has the state ID of Florida. The documents required for applying SSN are 1) passport 2) i-94 3) H1B approval copy Does she need anything else apart from the above list? Remember, if H1 was approved with change of status she must join her employer at the work location immediately. There is no bench period allowed. SSN has nothing to do with this. Link to comment

JoeF Posted April 7, 2017 Report Share Posted April 7, 2017 You can apply for an SSN when you are in a status that allows working. If your H1 was approved without COS, you have to go abroad, get an H1 visa, and enter with that visa into H1 status. Then you can apply for an SSN. And btw, not yet having the SSN is not a valid reason for the employer to not paying you in H1 status. Modern payroll system can handle the situation when the person has applied for an SSN but doesn't have it yet. Link to comment
