akpman Posted December 9, 2011 Report Posted December 9, 2011 My nephew was born on Jan 2, 1992. He is on H4 through his dad's H1. He attending an engineering school According to USCIS, the child has to be under 21. But, there are some interpretation that anyone entering 21 is not considered as child. Come Jan 3 , 2012 , will my nephew be out of status on H4 and be forced to change to F1? Or does he have 1 more year till Jan 2, 2013 ? Thanks, SV
