prince2020 Posted December 1, 2011 Report Share Posted December 1, 2011 I spent 5 years on H1 (continuous employment at US employer) and now moving back to India to start a new job. If I decide to come back through my new employer after 1 year in India (on L1 or H1b visa), will my H1/L1 time be reset? Will I get another 6 years or it will be only one year from my prev H1b clock. JoeF Posted December 1, 2011 Report Share Posted December 1, 2011 If you have been outside the US for one year, you can choose if you want the 1 year left on your current H1, or a new 6-year time. In the latter case, you would be subject to the quota. Link to comment
