honeycomb84
My F1 visa expired in July, 2011. I am currently on OPT (ending May, 2012) with my H-1B starting from April 2012. I am working as a consultant with a major IT firm. Can I travel international (India) on this status? Murthy attorneys, please advise. Thank you! Link to comment
livliv
Has your H1 petition already been approved? Is it with or without change of status? It is not advisable to travel if change of status has been approved, since on returning you will get a new F1 I-94 and the previously approved change of status may get voided. Not having a valid F1 Visa makes it more risky. You will have to apply for F1 Visa and being on OPT with H1 approved makes it difficult as you will not be able to show ties to home country. JoeF
You would need a new F1 visa to return. Link to comment
honeycomb84
Thanks JoeF for your response. If I enroll into F1 now, will that affect my H-1B which has a April 2012 begin date? If things work out, I want to travel in March. Please advise. Thank you. Link to comment
honeycomb84
@livliv Thank you for your response. Yes, my H1 petition is approved with a begin date in April 2012. I got the I-94 number along with it. Link to comment
JoeF
Thanks JoeF for your response. If I enroll into F1 now OPT is part of the F1. If you are using OPT, you are in F1 status. You just need a valid I-20 from your university to apply for an F1 visa. Link to comment
