H1 Cap exempt eligible ?

I had applied for H1 in year 2008 and got approved, but never gone for visa stamping or used it due to recession during 2008.

Am I eligible to apply for cap exempt H1 this year? What kind of special documentation is required (if any) to file cap exempt H1. I only have the case number from my previous employer/sponsorer. Do I need to get any more documents from them to file cap exempt H1.

you need not go for a new H1b . I think you can either extend or transfer your existing H1b...
