chandraguin Posted November 29, 2011 Report Share Posted November 29, 2011 I see several post in internet stating that one can receive money on 1099 only from passive income (i.e. stocks, interests etc) during H1B status. My question is: will it be legal from immigration stand point, to receive the money on 1099-MISC from a recruiter for relocation expenses? In my case my employer can not pay my relocation expenses as they do not have any relocation policy, so the recruiter agreed to pay on 1099 separately. Will it create issues on H1B status when I file GC? Please suggest. I have checked with my CPA that IRS will not have any issues, as long as I pay the taxes on the amount I receive through 1099. livliv Posted November 29, 2011 Report Share Posted November 29, 2011 It will not be a problem. You can even get reimbursed from other employers for interview expenses. But you cannot get paid for work/employment as an independent contractor. Link to comment
