It has been more than 1 year since I have been outside the US, so If an employer files for my new H1 now, will I be counted against the cap or would I be exempt? Thanks, Arkie Link to comment
JoeF Posted November 27, 2011 Report Share Posted November 27, 2011 A new H1 after 6 years would always be subject to the quota (unless it is for a quota-exempt organization, such as a university.) Link to comment
ashwinit Posted November 28, 2011 Report Share Posted November 28, 2011 @JoeF - If my first H1B petition was filed in 2005 and overall I still have 4.5 years left on my H1B till date (because I was on F1 and OPT, I did not exhaust my H1B 6 yrs period). Never been outside the US for more than a couple months. I am right now on H4 and looking for jobs. Will I still be subjected to quota if I find a new employer ready to file my H1B ? Link to comment
