Devaraj Posted November 22, 2011 Report Share Posted November 22, 2011 I am right now working with an employer in my CPT. My CPT gets over by Jan 17th for this semester. My employer had filed for my H1B on Nov 7th. I tried to track my receipt number but it says the number is invalid ( not yet updated ). If my H1B doesn't get approved before Jan 17th will go out of status ? I am planning to discontinue my studies.. I already have my Masters degree from US now I am in my PhD.. and I don't want to continue pursuing it. Link to comment

If my h1B doesn't get approved before Jan 17th will I be out of status ? Does having a receipt of h1b filling is sufficient for maintaining my legal status in US? Link to comment
hpagey Posted November 23, 2011 Report Share Posted November 23, 2011 USCIS will need to approve your h1b before your CPT expires. If you are expecting a delay, you can extend your CPT by a semester. If your h1b is rejected you will be out of status, if you haven't extended your CPT. Why not to apply in premium. That's what my company did for me. I am also on CPT. Link to comment
