srimatikrishnan Posted November 6, 2011 Report Share Posted November 6, 2011 I filed 140/485 concurrently in July 2007. I140 approved in 2008. My PD is current this month. Friday I received an e-mail notification that USCIS issued an RFE on my 485. My father's name spelling in my birth certificate and passport are different. ("Ravindran" in passport and "Raveendran" in my BC). I assume this is what the RFE is for. Belle/attorneys, how do I deal with this situation? Please help. Thanks Link to comment
srimatikrishnan Posted November 14, 2011 Author Report Share Posted November 14, 2011 I received the RFE yesterday. I have valid H1B through University of California till June 2012. The RFE says my H1B expired in June 2011 (incorrect). I did travel this July using my H1B and I have stamping on my passport till June 2012. I need to submit proof that I am continuing the same job for which my I-140 is based on. I can produce an employment verification letter from my employer. What else do I need to submit? Is a copy of my valid H1B good enough? US CIS also asked me submit a new G325A. Link to comment
Belle Posted November 14, 2011 Report Share Posted November 14, 2011 A copy of your I-94 would be best to prove status. EVL will work for the employment/offer proof (H1 is not good enough because you are a temporary worker on H1, and the job needs to be permanent). Link to comment

srimatikrishnan Posted November 29, 2011 Author Report Share Posted November 29, 2011 Finally got the approval notice last week for myself and my family. RFE received by the USCIS on 11/18/11. Approval notice sent on 11/22/11. Online status changed to "Card/Document production" on 11/25/11. Thanks to Belle and Murthy.com for the valuable advises. Link to comment
