I got the receipt number but waiting for the approval. My question: Can I apply for H1b transfer before I get the approval from the current H1b. Should I be in status to transfer my h1b ? If they are active and will be for sometime, then yes you can apply for transfer with the current extension being pending... However, if current petition is about to expire or has already expired, you will have to wait till the extension gets approved and then apply for transfer. Remember there is nothing like Transfer, it is always a new petition which is cap exempt Link to comment
