EB2 India recently current, but I-140 under ordinary processing

Guys, thanks in advancing for helping me out on this one. I’m EB2 India PD 9/21/2007 and an approved I-140 from previous employer. I had got my PERM approved and my attorney filed I-140 in September. This month, I found out that I’m current and we’ll be filing AOS in November. Will it help my case if I change my I-140 to premium processing? Should I be doing anything about this? I’m scared that I might get screwed since I just became current but my new I-140 was filed under ordinary processing.

I’m curious if I should change my I-140 to premium processing? Does it hurt my case that my I-140 was filed under ordinary processing while my dates are current? Will this cause a delay in my processing timelines for GC?

You can change to premium. It would probably make sense to do it now, so you know by the time you file I-485 whether your new I-140 is approved.

My case is similar to you and my new I140 in process as well and I have previous approved I140. My company lawyer suggested not to file premium and said that I can very well file AOS even I140 in process by just giving the current I140 receipt and the old approved I140.
