saj4u Posted October 13, 2011 Report Share Posted October 13, 2011 Guys, thanks in advancing for helping me out on this one. I’m EB2 India PD 9/21/2007 and an approved I-140 from previous employer. I had got my PERM approved and my attorney filed I-140 in September. This month, I found out that I’m current and we’ll be filing AOS in November. Will it help my case if I change my I-140 to premium processing? Should I be doing anything about this? I’m scared that I might get screwed since I just became current but my new I-140 was filed under ordinary processing. I’m curious if I should change my I-140 to premium processing? Does it hurt my case that my I-140 was filed under ordinary processing while my dates are current? Will this cause a delay in my processing timelines for GC? Link to comment
Belle Posted October 14, 2011 Report Share Posted October 14, 2011 You can change to premium. It would probably make sense to do it now, so you know by the time you file I-485 whether your new I-140 is approved. Link to comment

My company lawyer suggested not to file premium and said that I can very well file AOS even I140 in process by just giving the current I140 receipt and the old approved I140. Link to comment
