rishikeshhere Posted October 4, 2011 Report Share Posted October 4, 2011 I transferred by H1b in 2010 and my i94 that came with the i797 is valid till Feb 2012. But this year (2011) when i went to India and came back the Port of Entry officer gave me an i94 card valid till 28th Sept 2011 (that is the date my h1 stamping is expiring) Now, is my I94 on i797 is valid or the one i got at the port of entry is valid. Appreciate your comments on this.... Link to comment
JoeF Posted October 4, 2011 Report Share Posted October 4, 2011 The last I-94 always counts. You should have surrendered the previous I-94 when you exited the country, anyway. You always get a new I-94 at entry. Link to comment
pontevecchio Posted October 4, 2011 Report Share Posted October 4, 2011 If you actually showed him your latest H1 approval he made a mistake and you can have the CBP at the Airport correct the mistake. Even if you showed the older petition on entry you can still claim that you possibly showed the latest petition. Link to comment
