I came to India and due to delay in stamping H1, I lost my job and had to withdraw my visa in June 2011. I applied for H4 visa but currently I am working in India and soon I'm planning to join my wife in US. My question is, if i come to US in January (2012) and I manage to find a job in a company which agrees to sponsor my H1b, will I be exempt from the cap? I mean will I be able to start working once I get an H1B approval or would I have to wait for Oct. 1. What can be my start date on H1? Thank You!
