EB2 possible with Zone 4 job classification ?

- Is EB2 possible when DOL indicates a Job Zone 4 classification ? Does this have a high chance of Rejection/Audit ?

- Will a Business Necessity letter help significantly in this case ?

I just want to know if I should even consider EB2 with a job zone classification 4 or instead go for EB3 ??

EB2 classification is based on the employer's actual minimum requirements for the position, not the Job Zone.

However, if the employer's actual minimum requirements for the position exceed the Job Zone for that occupation, then the employer will need to be prepared to explain the business necessity reasons for those requirements.
