Raj_Chicago Posted May 29, 2011 Report Share Posted May 29, 2011 No that is not correct. But if you have a EB3 petition and you file a new EB2 petition, while your I-140 is approved you can port the EB3 priority date to EB2. Link to comment

veni001 Posted June 5, 2011 Report Share Posted June 5, 2011 Yes, your employer has to start from scratch for new EB2 application, and your attorney can request USCIS to port EB3 PD to new EB2 application at the time of EB2 i140 filing/approval. Link to comment
