H1B 1st Extension 2010-2013 Not stamped; no plans to go to India before 2013. My Question: Do I have to get the visa stamping done before 2013; or I can apply for further extension based on my approved I140? I posted this question here bec I am expecting my PD APR2010 (EB2) to be current before 2013 Sept; so that I can ditch H1B for GC. Link to comment

redgreenbluee Posted May 25, 2011 Report Share Posted May 25, 2011 please consult a lawyer. visa is an entry document, you need a valid visa to enter the US, once inside the US, your status is dictated by I-94 expiration, you can stay the US even if visa is expired as long as I-94 is valid (not expired). you will need to apply for a new visa when you leave the US before you can re-enter the US. you can also re-enter the US if you have a valid AP (eligible when you have applied I-485).
