EB3tangled
Here's the situtation, My labor (PERM) was approved, I-140 approved (EB3) and subsequently was filed I-485 in 2007. Earned MBA from University of Texas, found a job complementing my education & experience and qualifies under EB2 catergory. Please guide me how to make the switch? I meant what are the involved steps if I'd like to move from EB3 to EB2? Link to comment
Belle
There is nothing "involved". You just file a new case. Make sure you use your A number during I-140 filing. Link to comment
EB3tangled
Ok, thank you Belle. In that case how will I join the new company? Do I have to transfer my existing H1B or I can join with EAD (which I received part of EB3/ I-485)? Link to comment
Belle
You are not required to join the new sponsor until your green card is approved. If you want to join earlier, your work authorization is your business. Link to comment
