nirupa_18 Posted September 3, 2011 Report Share Posted September 3, 2011 Hi guys, I am current from July 1, 2011 (filed in 2007) and filed for my spouse on July 5. We got the receipts for him on July 14. I have received my approval on 07/18/2011 and FP for spouse completed on Aug 4, 2011. My spouse is on L1 visa and they are forcing him to go to offshore. He is going to quit the job and can he stay in USA with pending I-485 without any other visa. We are planning to go to India in November. Can he re-enter with Travel document and EAD. do you think any problems with this? Thanks for your help. Link to comment
pontevecchio Posted September 4, 2011 Report Share Posted September 4, 2011 He can stay as one pending AOS. As a derivative beneficiary he has absolutely no problems. He can certainly travel on AP and work on EAD till the GC arrives. Link to comment

SameerH1Bworker Posted September 6, 2011 Report Share Posted September 6, 2011 You should file his AP & you can go based on that AP. If you GC comes when you're out of US then at POE just inform them about it. They'll let you in US & will ask you to come back with your GC. Link to comment
