nick_usa Posted August 16, 2011 Report Share Posted August 16, 2011 Hi, I am working in US for company A on L1-Blanket visa, same company has also filed my H1, which got approved without I-94 and COS. So now, Can I continue my L1 status till the validity of my current I-94(Mar-2012) or do I need to go back to India and get my H1B stamping and again come back as H1B status? Link to comment
Attorney_22 Posted August 17, 2011 Report Share Posted August 17, 2011 Generally, when an individual’s H1B petition has been approved but without an attached I-94, the H1B status will not take effect until the individual has entered the U.S. at a point of entry pursuant to the approved H1B petition. Therefore, if an individual is already in the U.S. in a different valid status that individual will need to leave and reenter prior to commencing employment pursuant to the approved H1B petition.
