She will be traveling to India in a couple of months. My questions are as follows. Is she eligible to get her H4 visa stamped in India using her spouse's H1B approval notice while her H4 visa extension application is pending? Her H4 visa expires before she travels to India. Is there a need to cancel her H4 extension application after traveling to India? Should this be done after the visa is stamped? Is there any risk involved in travel in her situation? pontevecchio Posted September 27 Report Share Posted September 27 1. YES 2. No need. The visa stamp is only an entry document and the stay is based on the expiry of the spouse's H1 petition. 3. No risk as long as you are in valid H1 status with proof and you have no issues vis a vis your H1. Quote Link to comment
