Nakul J
My previous employer initiated my green card process, and my I-140 was approved. I continued working with them for another seven years until I was laid off due to a corporate restructuring during COVID-19 pandemic. I had switched to B-2 status briefly due to the COVID related travel restrictions and returned to my home country shortly after. My priority date became current at one point but it retrogressed again after a few months. Last year, I returned to the U.S. on an H-1B visa to start a new job. My priority date has become current again, but my new employer has not yet started the green card process. I understand that PERM processing is currently taking more than a year. I have a few related questions: How long can I continue on my H-1B after my priority date becomes current? Is there a stipulated period within which I must complete the green card process after my priority date becomes current? Assuming there is no retrogression, if it takes another two years to reach the adjustment of status stage, can I still continue with the GC process and my current employer continue filing H-1b extensions until my GC is approved? I would greatly appreciate your guidance on these questions. Quote Link to comment
