I 130 and I 485 filed for family based adjustment (Parents of US Citizen); have receipt notice for I 130 - can they stay beyond their current B2 visa allowed 180 days/

Recommended Posts

For both my parents, I filed immigration forms separately. Filed the I-130 online and received a notice of receipt (IOE) immediately and subsequently the I-485 was filed (by mail) a few months after. No news on the I-485 has come yet, just have the delivery receipt on 5/14/2024 from UPS is all I have.

Both of them are here in the US with us while we filed, their Admit Until data on the i-94 is fast approaching. So my question is related to that. Is the receipt notice of the I-130 legally  enough for them to stay longer than that date while the immigration application is being reviewed by USCIS?

Any and all help is welcome.

 Thank you in advance,

Abhi Oommen
