Approved original I797B lost in the mail

Recommended Posts

My H-4 to H-1B change of status (COS) was approved in early February, but I never received the approval notice (I-797B) in the mail. In April, I submitted an I-824 request for a duplicate copy. This delay prevented me from applying for a Social Security number (SSN) sooner. Recently, after contacting USCIS about the issue, they provided me with a soft copy of the approved H-1B petition. I used this and applied SSN in April and recieved in May. Given this background, I have some specific questions regarding my H-1B status and pay terms with my employer.

1. Does the 60-day H-1B grace period apply to my situation since I didn't receive the original approval notice and SSN right away ?

2. Is my employer legally obligated to pay me for the time I worked before applying for the SSN ?
