Hello,

I am planning to travel to Canada for couple of months and will be re-entry to states on July 20th. My visa is going to expire on 09/30/24 and my I-797A is valid till 09/30/24. Will I be allowed to re-enter in States with 2 months validity left on my visa and I-797A?

Thanks in advance

Yes, as long as you are entering the U.S. to continue working for that H1B employer pursuant to the terms of the petition.

I have a similar situation.

I have a H1B visa stamp valid till 09/30/2024. I plan to go to home country (India) in July 2024 and return in August 2024. I m also going to have a new I-797 approval as part of H1B extension. Can I re-enter US without having to go to visa stamping again and with new I-797. There is no change in employer.

Appreciate your response.
