Cabraghu Posted March 15 Report Share Posted March 15 Facts • Entered into US during May 2018 on L1A and have valid VISA stamp until Jan 2025. With recapture of days not stayed in US can extend up to April 2025 (max cap of 7 years) • Company applied for I140 during March 2023 and approved (PD: March 2023 under EB1) • As I will be exceeding the maximum cap of 7 years before my priority date become current, planning to apply for H1 now (March 6-22, 2024) with the same employer. Questions: 1. If my application selected in lottery in April 2024, can I transfer to H1 in October 2024 without leaving the country? 2. I will be completing 6 years of stay in US by April 2024, will this be an issue for applying H1 in October 2024 as I already completed 6 years cap of H1B limit by May 2024 itself. Is there any exception to this rule when I have approved I140 (under L1A) 3. Do I need to go through Lottery or can transfer to H1 without any lottery? Quote Link to comment
