CheckyStatus
Came to the USA in May. My employer is not running my pay stub. I have got a full-time opportunity, but they are asking for three months' paystubs. He is not responding to calls or messages also. If he doesn’t give me a pay stub, what is the best option for me to move to a new employer, and what legal action I can take against him? Edited November 11 by CheckyStatus Quote Link to comment
Attorney_24
In order to maintain valid status, an H-1B should be working and getting paid. Complaint can be filed with the DOL for unpaid wages. As it appears that you have not been maintaining status the new employer may have to file the H-1B for Consular Processing. Quote Link to comment
