Rathu Posted July 18, 2023 Report Posted July 18, 2023 This is regarding B-1/B-2 visa for my in-laws. They are currently residing in USA for last 5 months and we are planning to extend their stay for another 5 months. Their 10years multiple-entry visa is getting expired next year and will have to apply for renewal. Wondering whether is it OK to proceed with applying for their stay extension or not. In past (few years before) they had extended their stay once for an year. Kindly please suggest whether to extend their stay or not because they have their visa renewal coming up next year. Quote
Attorney_8 Posted July 25, 2023 Report Posted July 25, 2023 An applicant for a B1/B2 visa must show nonimmigrant intent based on their ties to their home country to be eligible for the requested visa. When someone has a history of long stays in the U.S., even if they timely applied for an extension, this may go against establishing the requisite nonimmigrant intent in the future. However, a B1/B2 visa application is based on specific individual circumstances and is subject to discretion by the consular officer. Quote
