I got laid off on April 7th 2023 and to avoid staying more than 60 day grace period I went to Canada as I had a tourist visa. I have a valid H1 visa from my previous employer until 2025. I recently got a job from a US based company. These are my questions: 1. Can my new employer file/transfer an H1 even if I am not in the country? 2. Can I enter US with my previous employer's H1 visa stamp or will I have to get a new visa stamp? Any help is appreciated. Thank You! Quote

Zodiac System Posted June 15, 2023 Report Posted June 15, 2023 Your new employer can file/transfer an H1 even if you are not in the country. You can enter US with previous employer's H1 visa stamp (and documents from new employer) as the status H1b is the same. Good Luck. Quote
