So please let me know that am I eligible for 60 days grace period or not ? Secondly, My H1B has been terminated by previous employer on 1st April 2023.Now I got a job offer from new employer. So I want to know that am I eligible to transfer my H1B to new employer during this grace period or I have to start the H1B filing (I129,lottery,I797) from initial ? Quote
Attorney_15 Posted June 27, 2023 Report Posted June 27, 2023 Generally, a grace period is available to someone if their H1B has not expired yet; a grace period will be either 60 days or the expiration date of the H1B, whichever is sooner. During a grace period one is in valid H1B status eligible for an H1B "transfer" (change of employer) petition just as when the person is still employed.
