question regarding second b2 stay extension filing

Recommended Posts

Hello,

We applied for an extension of our B2 stay and requested status be extended for 204 days (until the return travel date) which is more than the usual approval of 182 days and the current application is still pending, do we need to apply for another extension even though we have requested the status extension until return travel date which exceeds by a few days of 180 days period.

will uscis ever issue approval for more than 182 days for a b2 extension?  it takes another 1year to get approval for my pending application. If we leave the country before the decision of the current application, will uscis give us until the departed date on approval even if it's a few more days than the standard 180 days?

If we need to apply for a second time it would be just for 22 more days.

Please suggest.

Thanks in advance !!

By regulation, B2 extensions of stay can only be given in increments of not more than 6 months, so they cannot issue an approval for 204 days.

Therefore, it only makes sense to apply for a second extension of stay if it is filed within 6 months of the expiration of status, since the whole point of a second extension of stay application is so that in case the first one is approved while you are still in the US, you still have a pending extension that was filed before the status granted by the first extension, that allows you to stay. But a second extension of stay application that is filed beyond the 6 months that the first approval can be granted for doesn't give any benefit, since it won't be timely-filed even if the first one is approved.

If the first extension of stay is still pending when you leave the US, then it doesn't matter if you filed a second one or not.

If you leave the US while the application is pending, it is automatically abandoned since you don't have status when outside the US, so there is no status to extend anymore once you leave. It becomes moot whether it is approved or denied.
