I did not go for visa stamping as the position was later canceled. Can a new employer file an H1B petition for me now in Cap Exempt quota? Thank you. Quote Link to comment
JoeF Posted April 4 Report Share Posted April 4 No, because you are only considered counted for the quota if you started working on the H1 or at least got the H1 visa stamp. Having said that, sometimes USCIS approves an H1 transfer without that, but don't count on it. Quote Link to comment
