My wife is planning to quit her job and change her status from H1B to H4 (as my dependent). How should we go about it? If she quits right after getting the I-539 reciept, she will stop receiving paychecks which will invalidate her H1B. Can she continue to remain in H1B without pay till her change of status to H4 is approved (current timeline is 5-6 months)? Appreciate your response. newacct Posted January 19 Report Share Posted January 19 Her H1b status will end either 60 days after she ceases working, or when her I-94 expires, whichever is first. After that she will be out of status, but she can stay in the US for as long as her I-539 is pending. Quote Link to comment
