aks1993
I need to travel to my home country. I am on F1 visa (STEM OPT) and my employer applied for PERM a month ago and it is still pending. Since F1 is a single intent visa, is it safe to travel on this status while PERM is filed? I do have a valid EAD and have signed I-20 from university. Quote Link to comment
Attorney_10
Provided that the F-1 visa holder is compliant with F-1 travel requirements (i.e., valid F-1 visa stamp, valid I-20 travel signature, valid and unexpired passport, etc.), it is ok to travel during the PERM process and the PERM application should not be affected. Every case is different. Therefore, prior to taking any specific action it is advisable to speak with an experienced U.S. immigration attorney as there are nuances to any situation and approach. https://www.murthy.com/client-services/hire-us/ Quote Link to comment
