University administrative error - did not transfer H1, now out of status for over 100 days

Pretty stressful overall - found out a few weeks back my employer university (large well known) did not transfer H1 from previous university (administrative staff likely missed sending the paperwork).

After submitting LCA again and doing the paperwork we received an RFE - now university counsel is advising leaving the country immediately and going for consular processing instead - as they are concerned we will may not receive an approved I-94.

Visa interview appointment dates in India are another headache.. 

Planning to leave ASAP - any advise would be appreciated.
