It has been less then 2 months and due to Project related concerns, I want to go back to Employer A. Can I go back to Employer A? if so, Should I initiate a fresh H1b transfer or Can I use my existing h1b with Employer A. Both Employer A and Employer B LCA location were same, and within 60 days we can go back to Employer A without new H1 transfer not sure. Please advise on this. Quote Link to comment

Attorney_14 Posted November 14, 2022 Report Share Posted November 14, 2022 If there has been no material change in the previous employment (meaning an individual’s job duties are the same and in the same location as the previous employment), the LCA has not been withdrawn by the previous employer, and the I-797 approval is still valid, then an individual may return to work for a previous employer without filing a new petition.
