Question on new H4 and H4 EAD filing.

Hi 

I am getting married this Dec 2022 and I have scheduled my wife's H4 VISA slots for Jan 2023. I have a few questions regarding it. 

1) How long does my wife need to stay in USA so that I can file her H4 EAD ?

2) Can she travel to India and come back with EAD pending ?

I am on H1-B with approved I-140 from my previous employer, I am currently employed at a different company.
