viswah1b Posted July 11, 2022 Report Share Posted July 11, 2022 Hello, My current H1B stamping is ending by October 25th. I got my extension approved until 2025. I have to visit India due to a health emergency. I am unable to get a slot for h1b dropbox in any of the consulates. The earliest dates are in 2023. I am planning to travel to India in Aug and be back to USA by October 1st week. At the port of entry if I show my approved i797 with the extended date will the i94 of me and my wife be updated to reflect that? The reason i am looking for an updated i94 is for my spouse's EAD application. Thank you for responses. Quote Link to comment
Zodiac System Posted July 13, 2022 Report Share Posted July 13, 2022 Make sure that both your passports has validity (more than one year), to accommodate the I-94 stamp until 2025 at US immigrations, or else renew your passports. Quote Link to comment

If you show your new H1b petition approval, you should be admitted on a new I-94 until the expiration of that petition (unless your passport expires earlier). If your spouse is entering with you on an unexpired visa, they should be admitted on a new I-94 with the same expiration as yours. Quote Link to comment
