28117
Hi, I have filed my Green card process through my previous employer and got my I140 approved with the priority date of 15-JAN-2015. After this date i switched to a new employer in 2020(crossing 180 days retention mark). Now my new employer is starting the GC process using same priority date. I checked the Priority dates for EB2 which is now showing 01-DEC-2014 which is just a month away from my priority date. Questions:. 1. My Current employer mentioned the GC process takes 8-10 months or later too. Will this impact my Priority date? 2. What will happen if my priority date is reached and my GC process with my new employer is still in progress? 3. How much time will my priority date retained after the current date of priority date is reached? Please let me know your suggestions. Thanks. Quote Link to comment
pontevecchio
Your PD remains untouched. But retrogression may be possible delaying your ability to file AOS after the GC is approved. Quote Link to comment
