Expired H1B and quota exception

I had a H1B approved in 17-Dec-2007 and its expiry date is 29-Sept-2010. But I never travelled USA on H1B due to personal reasons at that time.
If I apply H1B now, do i need to go through lottery (next year April) or can i directly go through premium processing for H1B now.

I am in USA for the last 2 years on L1A as a functional manager. Since EB1C is a difficult bet, I want to check the alternatives with H1B. Please suggest.
