chattes Posted May 27, 2022 Report Share Posted May 27, 2022 I was employed by a company that applied for my green card under the EB2 category. My priority date was in early 2016. My division was shut down at the end of 2018, and everyone was laid off. However, because of the 180-day rule, I still got an approved H1B (at a university). My I-140 case status says "Petition Withdrawn/Over 180 Days/Not Automatically Revoked". My question is - if I self-petition now, can I not use this priority date as my priority date or I will get a new priority date? Quote Link to comment
