Vamsikandarpa
Hello, I have got a H1B petition filed by ex-employer in 2014 but I never got a chance to travel to USA. Is it possible for another employer to process it under cap-exempt and transfer now. Quote Link to comment
Zodiac System
There are several schools of thought on this subject. Some attorneys claim they have been able to process such H1b's. If you have an employer willing to process your previous H1b under cap-exempt, please go for it. Good Luck. Quote Link to comment
pontevecchio
Unless you got the H1 visa stamp, you will not be considered cap counted and will be subject to the lottery. Quote Link to comment
JoeF
Did you get an H1 visa? Then you have been counted for the quota and the H1 can be transferred. Quote Link to comment
dinupat
I have one question, if I have H1 Visa from cap exempted category from 2016 and apply for GC, and now suppose I got H1 from capped category, will my GC priority date change for today date or it will be still 2016. Please help me with this. Quote Link to comment
