Employer is not sharing the NOIR copy so not sure about the reason. Does USCIS consider the stay from the time of initial petition approval to till date as illegal stay? Does transferring H1B to a new employer help? Can the beneficiary apply for H4 before NOIR decision (spouse has I-140 approved)?Does that help to maintain the status? if anyone had faced this situation previously, Please help .
